These Terms set out the conditions of use of WATTAGAM (hereinafter the "Service") and the rights, obligations, and responsibilities of the Company and Users. In this document, the "Company" means the entity that provides the Service.

Article 2 (Definitions)

  1. "Service" means the mobile app, server API, and related web/administration features provided by the Company that allow Users to record short video scenes and locations during a trip, view them in the form of a map and a travel movie, and share them with trip participants.
  2. "User" means a Member who uses the Service in accordance with these Terms.
  3. "Account" means the login unit created to identify a User and to use the Service.
  4. "Trip" means a unit of travel record created by a User, including a title, city, country, period, representative coordinates, participation code, Participants, and Scenes.

  8. "Location Tracking" means the feature by which the app records location in the background or foreground for a Trip that the User has explicitly turned on, and displays it as the Trip route.
  9. "Plan" means the list of destination titles, dates and times, locations, and notes that a User writes directly for each Trip.
  10. "End-to-End Encryption" means a structure in which data is encrypted on the User's device and decrypted on the devices of authorized Participants, so that the server cannot directly know plaintext video, plaintext Location Tracking coordinates, or plaintext Plan content.

Article 3 (Posting and Amendment of the Terms)

  1. The Company posts these Terms on the in-app legal documents screen or by an equivalent method.
  2. The Company may amend these Terms to the extent that doing so does not violate applicable laws and regulations.
  3. When amending the Terms, the Company will give notice of the amendments, the effective date, and the reasons for the amendment for a reasonable period before the effective date. For amendments that are unfavorable to Users or material, the Company will give separate notice or obtain consent in the manner required by law.
  4. If a User continues to use the Service after the effective date of the amended Terms, the User may be deemed to have agreed to the amended Terms. However, where explicit consent is required by law, the Company will obtain separate consent.

Article 4 (Accounts and Login)

  1. Users may create an Account and use the Service through the social login methods provided by the Company, such as Google, Apple, and Kakao.
  2. The accuracy and availability of authentication information provided by a social login provider, and changes to its policies, are governed by that provider's policies.
  3. To prevent misuse and to operate the Service, the Company may limit the number of Accounts that can be created from a single device. Under the current policy, the maximum number of Accounts that can be created with one registered device ID is three (3).
  4. For Account security, the Service may limit the number of active login sessions for an Account. Logging in on a new device may cause the session on an existing device to expire.
  5. Users must manage access to their own Account and devices themselves, and must not lend, transfer, or share the means of accessing their Account with any third party.
  6. The Company may restrict use of the Service if Account information is false or uses another person's information, or if these Terms or applicable laws are violated.

Article 5 (Content of the Service)

The Company provides the following features.

  1. Creating, editing, deleting, and viewing the list of Trips
  2. Joining a Trip through a participation code
  3. Capturing, saving, synchronizing, and playing short video Scenes during a trip
  4. Map display based on the capture location and time of Scenes
  5. Sharing Scenes, profiles, comments, likes, and location routes among Trip Participants
  6. Location Tracking feature
  7. Creating Plans for each Trip (destinations, times, locations) and joint editing among Participants
  8. Protection of media, Location Tracking, and Plan data based on End-to-End Encryption
  9. Encryption key management, such as device registration, device approval, and Travel Key sharing
  10. Exporting Trip movies

The Company may change, suspend, or add some of the features as needed for Service improvement, security, or operations.

Article 6 (Trip Participation and Scope of Sharing)

  1. A Trip owner may invite other Users to a Trip through a participation code.
  2. When a User who has received a participation code joins a Trip, that User can view the Trip records, such as the Trip's Scenes, Participant profiles, comments, likes, location routes, and Plans.
  3. Users must share a participation code only with people they trust.
  4. The author of a Scene recorded by a Participant is shown as the User who uploaded that Scene.
  5. A Trip's Plan can be written and edited jointly by Participants. That is, a Participant may also edit or delete a Plan item written by another Participant, and to avoid simultaneous editing of the same item, an item being edited cannot be edited by other Participants for a certain period of time.
  6. The Company has no obligation to intervene in disputes arising from relationships among Trip Participants, the passing on of participation codes, or the sharing of Trip records. However, the Company may take necessary measures if there is a report of a violation of law or an infringement of rights.

Article 7 (Location-Based Services)

  1. The Service may use location information to save the capture location of Scenes, display maps, display Trip routes, and set the map center when the app starts.
  2. Location permission may be required to capture Scenes, and without location permission, the capture or map recording features may be restricted.
  3. Location Tracking operates only when the User has turned it on directly in the Trip settings.
  4. Turning on Location Tracking may require the operating system's location permission, in particular the "Always Allow" permission for background recording.
  5. Location Tracking can be turned on for only one Trip at a time.
  6. Location Tracking cannot be newly turned on for a Trip whose travel period has ended, and Location Tracking that was on may be stopped automatically.
  7. When Location Tracking is turned off, subsequent location recording stops, but location history that has already been saved is not deleted automatically. Users may request deletion of their location records through a separate deletion feature or a customer support request.
  8. Location records may be missing or inaccurate due to the operating system, network, battery saving policies, permission changes, GPS error, or background restrictions.
  9. If neither GPS nor the Trip coordinates on file are available, the map center at app start is set to the default coordinates (Seoul).
  10. Matters concerning the purpose of collection and use of personal location information, the retention period, the method of destruction, the rights of data subjects of personal location information and their legal representatives and how to exercise them, and the retention of materials for verifying the facts of collection, use, and provision are set out in the Privacy Policy.
  11. Inquiries about location information may be made through customer support under Article 20 or through the contact point in the Privacy Policy.

Article 8 (Rights to Content)

  1. As a rule, the rights to Content that a User records or uploads to the Service belong to that User.
  2. The User grants the Company a non-exclusive right to use the Content to the extent necessary for providing the Service, storage, synchronization, encryption processing, delivery to Participants able to decrypt it, map display, thumbnail display, movie export, customer support, security, and operations.
  3. The Company does not use a User's Content for advertising, promotion, or provision to third parties beyond what is necessary to provide the Service. Where separate use is required, prior consent will be obtained.
  4. Users must hold the lawful right to record and upload the Content, and must not infringe the face, location, privacy, copyrighted works, trademarks, reputation, or portrait rights of others.
  5. When a User films a public place or companions, the User must obtain the consent of the persons concerned where necessary.

Article 9 (Prohibited Acts)

Users must not engage in any of the following acts.

  1. Using another person's Account or social login information
  2. Signing up with false information or circumventing the per-device Account limit
  3. Recording or sharing Content that infringes another person's personal information, location information, privacy, portrait rights, or copyright
  4. Recording, uploading, or sharing illegally filmed material, obscene material, violent content, or content that violates laws for the protection of children and youth
  5. Using location information or Trip records for improper purposes such as stalking, surveillance, harassment, or intimidation
  6. Acts that harm the stability of the Service, such as inserting malicious code, abnormal requests, crawling, reverse engineering, or bypassing security
  7. Infringing or attempting to infringe the servers, networks, storage, or encryption key systems of the Company or third parties
  8. Publicly disclosing a participation code to an unspecified number of people, causing unwanted access
  9. Other acts contrary to applicable laws, these Terms, or public order and morals

Article 10 (End-to-End Encryption and Device Management)

  1. The Service encrypts newly uploaded Scene videos and thumbnails on the User's device before storing them on the server.
  2. Trip Location Tracking coordinates and Plan content (destination titles, times, locations, notes) are encrypted on the User's device at the time of upload, and the server stores the encrypted payload.
  3. The server stores and relays encrypted media files and encrypted keys, but does not directly hold plaintext media, plaintext Location Tracking coordinates, or plaintext Plan content.
  4. Viewing existing Trip media on a new device may require device approval and delivery of encryption keys.
  5. If a User loses all approved devices or can no longer access the encryption keys, the Company may be unable to recover the encrypted Content.
  6. Users must keep their devices secure, and if loss, theft, or unauthorized access is suspected, must promptly take necessary measures such as logging out, blocking device access, and contacting customer support.

Article 11 (Restrictions on Use of the Service and Content Measures)

  1. If a User violates these Terms or applicable laws, the Company may restrict use of the Service or change the status of the Account.
  2. In the event of a report of rights infringement, a report of illegal information, or a lawful request from an investigative agency or court, the Company may take necessary measures such as restricting the display of, deleting, or preserving the relevant Content.
  3. Due to the encryption structure, the Company may be unable to check the plaintext of all Content in advance. In that case, the Company will take necessary measures based on reports, metadata, materials submitted by Users, and requests under laws and regulations.
  4. A User who objects to a restriction on use or a Content measure may raise an objection through customer support or the privacy inquiry contact point.

Article 12 (Deletion, Withdrawal, and Data Processing)

  1. Users may delete Scenes they have created. When a Scene is deleted, the Scene record in the server DB and the corresponding Scene media stored in GCS are deleted.
  2. A Trip owner may delete a Trip that the owner owns. After a Trip deletion request, the Trip is no longer shown in the app, and a background job on the server sequentially deletes the Trip, Scenes, media, Participants, and encryption keys.
  3. Users may request deletion of their location records or use the deletion feature provided in the app. Turning off Location Tracking alone does not delete existing location records.
  4. Plan items of a Trip can be deleted by the Participants of that Trip, and when the Trip is deleted, the Plan items of that Trip are deleted together. When an Account is deleted, the Plan items the User created are also deleted.
  5. Users may delete their Account at any time using the in-app account withdrawal feature. Upon withdrawal, the Account status is switched immediately, login sessions are terminated, and identifying information such as email is destroyed. Afterward, a server background job sequentially deletes the Trips owned by the User (where there are no other Participants) and the Scenes, location records, encryption keys, and registered device information created by the User. A Trip that has other Participants is not deleted; ownership is automatically transferred to another Participant, and only the Scenes created by the withdrawing User are deleted. The detailed processing procedure follows Article 4 of the Privacy Policy. Inquiries about Account deletion may also be received through the in-app bug report or the privacy inquiry email.
  6. If a User deletes the app, locally stored data on that device may be deleted, but the Account, Trips, Scenes, comments, likes, and location records synchronized to the server may remain until a separate deletion request is made.
  7. Information necessary for statutory retention obligations, dispute response, and investigation of misuse may be retained separately for the necessary period.

Article 13 (Changes to, Suspension of, and Failures in the Service)

  1. The Company may change or suspend all or part of the Service for Service improvement, security, operational needs, legal compliance, or changes in external service policies.
  2. Provision of the Service may be temporarily suspended for any of the following reasons.
    • Failures of servers, databases, storage, or networks
    • Failures of external services such as cloud, map, and social login services
    • App updates, maintenance, security patches
    • Natural disasters, power outages, communication failures, and other force majeure
  3. Where a Service suspension is anticipated, the Company will give prior notice to the extent possible. In the case of urgent security response or failure recovery, notice may be given afterward.
  4. When offline or on an unstable network, Scenes or location records may be saved on the device first and synchronized later. If the app is deleted, or the device or storage is damaged, before synchronization, records that have not been uploaded to the server may not be recoverable.

Article 14 (External Services and Third-Party Services)

  1. The Service uses external services such as Google, Apple, Kakao, Google Cloud Storage, and Mapbox.
  2. The availability, failures, policy changes, personal information processing, and account suspension of external services are governed by each provider's policies.
  3. Due to failures of or policy changes to external services, login, map display, media storage, and app distribution features may be restricted.
  4. Users must also review the account policy and privacy policy of each social login provider.

Article 15 (Advertising and Paid Services)

The Service does not currently offer paid payments, subscriptions, in-app purchases, or advertising features. If the Company offers paid services, advertising, or promotional features in the future, separate terms, notice, or consent may apply.

Article 16 (Protection of Personal Information)

The Company protects Users' personal information in accordance with the Privacy Policy. Matters concerning the collection, use, retention, deletion, entrustment, overseas transfer, processing of location information, and exercise of User rights regarding personal information are set out in the Privacy Policy.

Article 17 (Limitation of Liability)

  1. To the extent permitted by applicable laws, the Company is not liable for Service disruptions or damages that arise without intent or negligence on the part of the Company.
  2. The Company is not liable for Service disruptions, data loss, rights infringements, or disputes arising from causes attributable to the User.
  3. The Company is not liable if a User infringes the rights of a third party in the course of recording or sharing Content.
  4. The Company is not liable for problems arising from failures of or policy changes to GPS, networks, operating systems, external map services, social login providers, or cloud providers, unless the cause is attributable to the Company.
  5. The Company is not liable where encrypted Content cannot be recovered due to the loss of encryption keys or approved devices. However, this does not apply where the Company acts with intent or gross negligence.
  6. This Article does not exclude or limit the Company's liability under mandatory provisions of law, such as the Personal Information Protection Act, the Act on the Protection and Use of Location Information, and consumer protection laws and regulations.

Article 18 (Compensation for Damages)

  1. If the Company or a User causes damage to the other party by violating these Terms or applicable laws, the party at fault will compensate for the damage in accordance with applicable laws.
